Plain-English Summary: These terms explain the rules for using BrightSocial. We provide the platform as a helpful tool, but we are not responsible for the activities listed by organizers or any events you attend. Please read the Disclaimer and Limitation of Liability sections — they are important.

Acceptance of These Terms
Section 1

By accessing or using BrightSocial (our website at brightsocial.ca and our web application), you agree to be bound by these Terms of Use. If you do not agree, please stop using the service.

These terms apply to all users of BrightSocial, including seniors who browse and register for activities, family members who help set up accounts, event organizers who list programs, and administrators who manage the platform.

If you are setting up an account on behalf of another person (for example, helping a parent), you represent that you have their permission to do so and that they agree to these terms.


What BrightSocial Offers
Section 2

BrightSocial is an online directory and booking platform that helps seniors in Greater Victoria, BC, discover and register for local activities, programs, and social events.

We provide:

  • A searchable directory of senior activities and events in Greater Victoria
  • The ability to create an account and save events to your personal plan
  • A guest browsing mode that does not require an account

BrightSocial is an information and booking platform only. We do not operate, run, or organize any of the events listed on the platform. All events are created and managed by independent organizers — community centres, clubs, and other organizations.


Your Account
Section 3
Creating an account

To save events and access personalized features, you need to create a free account. You must provide accurate information when signing up, including a valid email address and your real name.

Keeping your account secure

You are responsible for keeping your password confidential and for all activity that occurs under your account. If you believe someone has accessed your account without permission, please contact us immediately at support@brightsocial.ca.

One account per person

Each person should have one account. You may not create accounts for other people without their knowledge and consent.

Minimum age

You must be at least 13 years old to create an account. BrightSocial is designed for adults.


Acceptable Use
Section 4

BrightSocial is a friendly, community-focused platform. We ask all users to treat others with respect. You agree that you will not:

  • Use the service for any illegal purpose
  • Submit false information or impersonate another person
  • Misuse event listings or submit false information about attendance
  • Harass, threaten, or be abusive to other users or organizers
  • Attempt to access another person's account
  • Use automated tools to scrape, copy, or extract content from BrightSocial
  • Post spam, advertisements, or irrelevant content
  • Attempt to disrupt, damage, or overload our systems

We reserve the right to remove content and suspend or terminate accounts that violate these rules.


Event Organizers
Section 5

If you apply to list events on BrightSocial as an organizer, additional terms apply to you.

Accuracy of listings

You are solely responsible for ensuring that all event information you post is accurate, up to date, and not misleading. This includes dates, times, locations, costs, and accessibility information.

Your responsibility to attendees

You are responsible for the safe and proper operation of your events. BrightSocial is not a party to the relationship between you and your attendees. Any disputes between organizers and participants are between those parties.

Content you post

By posting event listings, you confirm that you have the right to post that information and that it does not infringe anyone else's rights. You grant BrightSocial a licence to display your event information on the platform.

Fees and subscriptions

Organizer accounts include a 14-day free trial. After the trial, a monthly subscription fee applies. We will notify you clearly before any charge is made. All fees are in Canadian dollars.

Removal of listings

We reserve the right to remove any event listing that violates these terms, is inaccurate, or is otherwise inappropriate, at our sole discretion.


Third-Party Content and Links
Section 6

BrightSocial may contain links to external websites or services (for example, a community centre's website). These links are provided for your convenience only. We do not control, endorse, or take responsibility for the content of external sites.

We also use Supabase, a third-party technology provider, to manage user authentication and data storage. Your use of these features is also subject to Supabase's terms of service.


Disclaimer of Warranties
Section 7

Please read this carefully. This section limits what BrightSocial is responsible for.

BrightSocial is provided "as is" and "as available," without any warranties or guarantees of any kind, either expressed or implied.

We do not warrant or guarantee that:

  • The service will always be available, uninterrupted, or error-free
  • Event listings are always accurate, complete, or up to date — organizers are responsible for their own listings
  • An event will take place as listed — organizers may cancel or change events at any time
  • The service will meet your specific needs or expectations
  • Any information on the platform is free from errors or omissions

BrightSocial is a listing and booking platform only. We are not responsible for the quality, safety, or conduct of any event listed on our platform. When you attend an event, you do so at your own risk and under the terms and supervision of the event organizer.

If an event is cancelled, changed, or unsatisfactory, your recourse is with the event organizer, not with BrightSocial.


Limitation of Liability
Section 8

Please read this carefully. This section significantly limits BrightSocial's legal responsibility to you.

To the maximum extent permitted by the laws of British Columbia and Canada, BrightSocial, its owners, employees, contractors, and agents will not be liable to you or any other person for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of data, loss of profits, or loss of business opportunity
  • Personal injury or property damage arising from your use of the service or attendance at any event
  • The conduct, actions, or omissions of any event organizer or other user
  • Errors, inaccuracies, or omissions in event listings
  • Any event being cancelled, changed, or unavailable
  • Unauthorized access to or alteration of your account or data, despite our reasonable security measures
  • Any interruption or cessation of service

In any case where we are found liable to you despite the above, our total liability to you for all claims combined will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) one hundred Canadian dollars ($100 CAD).

Some provinces do not allow certain limitations of liability. In those cases, our liability will be limited to the minimum permitted by applicable law.

BrightSocial is not a healthcare provider, emergency service, or social services agency. We do not provide medical advice, personal care, transportation, or supervision. If you or someone you know has a medical emergency, please call 911.


Your Responsibility to Us
Section 9

By using BrightSocial, you agree to protect and hold harmless BrightSocial, its owners, employees, and contractors from any claims, damages, losses, or costs (including reasonable legal fees) that arise from:

  • Your use of the service in violation of these terms
  • Any content you post or information you provide that is false, inaccurate, or misleading
  • Your violation of any applicable law
  • Any dispute between you and another user or event organizer

This means that if your actions cause problems for BrightSocial, you are responsible for those consequences.


Dispute Resolution
Section 10
Talk to us first

If you have a complaint or concern, please contact us first at support@brightsocial.ca. We genuinely want to resolve issues fairly and quickly, without the need for formal proceedings.

Governing law

These Terms of Use are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to any conflict-of-law rules.

Jurisdiction

If a dispute cannot be resolved through direct communication, you agree that any legal proceedings will take place in the courts of British Columbia, Canada, and you submit to the exclusive jurisdiction of those courts.

No class actions

To the extent permitted by law, all disputes must be brought on an individual basis. You may not bring claims as part of a class action or representative proceeding.

Limitation period

Any claim you wish to bring against BrightSocial must be started within two (2) years of the event giving rise to the claim. After that time, any claim is permanently barred, to the extent permitted by law.


Termination
Section 11
You can leave at any time

You can stop using BrightSocial and close your account at any time. To delete your account, go to your profile settings in the app, or email us at support@brightsocial.ca and we will take care of it within a few business days.

We may suspend or close accounts

We reserve the right to suspend or permanently close your account if:

  • You violate these Terms of Use
  • Your account is used for fraudulent, abusive, or illegal activity
  • You provide false information when registering
  • We are required to do so by law
  • Continuing to provide you access would harm other users or the platform

Where possible, we will give you notice before taking action and an opportunity to respond. For serious violations, we may act immediately without notice.

What happens when an account is closed

When an account is closed — by you or by us — your access to the platform ends immediately. We will handle your personal information in accordance with our Privacy Policy. Any RSVPs you held are automatically cancelled, and organizers will be notified where required.

Clauses that survive termination

Even after termination, the following sections of these terms continue to apply: Disclaimer of Warranties (Section 7), Limitation of Liability (Section 8), Your Responsibility to Us (Section 9), and Dispute Resolution (Section 10).


Changes to These Terms
Section 12

We may update these Terms of Use from time to time. When we do:

  • We will update the "Last updated" date at the top of this page
  • If the changes are significant, we will send a notice to your registered email address at least 14 days before the changes take effect
  • Continuing to use BrightSocial after the effective date means you accept the new terms

If you do not agree with changes to the terms, you should stop using the service and close your account before the new terms take effect.
